Welcome to Rachel Bowman Art! These terms and conditions ("Terms") govern your use of our website, located at rachelbowmanart.com, and any related services provided by Rachel Bowman Art.

By accessing or using our website, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our site.

1. About Us

Rachel Bowman Art is an art portfolio and online store operated by Rachel Bowman, based in San Diego, California. You can contact us at rachelbowmanart@gmail.com.

2. Use of the Website

By using this website, you agree to comply with these Terms and all applicable laws and regulations. Unauthorized use or modification of any content is strictly prohibited.

3. Intellectual Property Rights

All content on this website, including images, artwork, logos, and text, is the exclusive property of Rachel Bowman Art and is protected under U.S. copyright laws. You may not use, copy, reproduce, or distribute any content from this site for commercial purposes without prior written permission. As the artist, I retain full copyright to all artwork I create, including mock-ups and prints. This allows me to produce prints and other reproductions featuring the artwork. Commissioned portraits may also be displayed in my website gallery and on social media. If you prefer your portrait to remain private, please let me know before I begin working on it.

4. Sales, Delivery, and Return Policies

  • Sales: All sales are final upon checkout. Commission purchases are valid for 1 year, after which their value can be put towards a new commission (subject to periodic price increases). Gift cards are nonrefundable but do not expire. Gift card purchase date does not dictate the final cost of the commission. By making a purchase, you agree to provide accurate and complete information for payment and delivery.

  • Delivery: Order process time varies depending on waitlist size and time of year but can take up to 4 months. I will provide an estimated completion deadline upon purchase. If the piece must be completed by a certain date please contact me prior to purchasing to determine if I can meet the deadline. Orders are shipped via FedEx Express in 1-3 business days upon completion and a tracking number will be sent. If sending as a gift, the portrait can be shipped directly to the recipient. Order deliveries will not require a signature unless the customer specifies otherwise at the time of purchase, and customers are responsible for damage or disappearance of the order once it has been delivered to their address.

  • Approval: An image of the final artwork will be emailed for approval prior to mailing, after which the customer has 5 business days to request up to three small, free alterations (as defined by the artist). If further alterations are requested, a $30 per hour fee will be incurred. Any alterations will reasonably delay the delivery date. Once the artwork is delivered by mail, the customer has 5 business days to request further alterations, subject to return delivery costs, new delivery costs, and a $30 per hour fee for any alterations. Artist retains the right to deny alterations at any time or to move alterations to the back of the waitlist.

  • Returns & Refunds: Due to the nature of custom work, all sales of original and commissioned artwork are final. Commissions may be canceled at any time leading up to the beginning of work, but will be credited towards another purchase rather than refunded. Orders that are canceled after work has begun will neither be credited nor refunded. Prices are subject to change periodically, but guaranteed for a year following the initial purchase. No refunds or returns will be accepted for commissioned pieces. Fine art prints are not guaranteed to perfectly match the original, though every attempt is made to match them as closely as possible in terms of quality and color. Fine art prints may be returned for store credit within 30 days if undamaged, but customers are responsible for the return postage costs. If an item is damaged during shipping, please contact us within 7 days of delivery for a replacement or credit (order will be added to the waitlist).

5. Payment Methods

Payments must be made in full before customers are added to the waitlist. I accept the following payment methods:

  • Credit/Debit Cards (Visa, MasterCard, American Express, Discover)

  • Other payment options as listed at checkout

6. Public Comments and User Conduct

  • Users may leave comments where enabled but must not post anything unlawful, defamatory, or infringing on others' rights.

  • Copyright infringement in comments is not allowed.

  • We reserve the right to remove any comments or block users who violate these guidelines.

7. Copyright Infringement Policy

If you believe that content on our website infringes on your copyright, please contact us with:

  • A description of the copyrighted work

  • A link to the alleged infringing material

  • Your contact information We will review and take necessary actions per the Digital Millennium Copyright Act (DMCA).

8. Restrictions on Sharing and Use of Content

  • Visitors may not share or distribute protected images or videos from this site without written permission.

  • No content may be used for commercial purposes without authorization.

9. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to its conflict of laws principles. Any disputes shall be resolved in the courts of San Diego County, California.

10. Updates to These Terms

We may update these Terms from time to time. Any changes will be posted on this page, and your continued use of the website signifies your acceptance of the updated Terms.
